The exact scope, deliverables, timing and price of a service will be defined in the applicable proposal, quotation, order form, statement of work or other written agreement. We may change, expand or discontinue particular service offerings from time to time.
4. Digital Products, Memberships & Subscriptions
My Rising Jungle may offer digital products and resources, including but not limited to templates, content libraries, guides, courses, downloadable materials, memberships and other digital content. The specific content, price, access period, payment terms and any additional conditions applicable to a digital product or membership will be stated on the relevant sales page, checkout page or offer at the time of purchase.
Licence and permitted use
Unless otherwise stated, purchasing a digital product grants you a limited, non-exclusive and non-transferable licence to use the materials for your own personal or business purposes. Where appropriate to the product, you may adapt templates, captions, prompts and similar resources and use the resulting content within your own business and marketing. You may not resell, redistribute, sublicense or share purchased materials or account access with unauthorised third parties. You may not reproduce or distribute our digital products, or substantial portions of them, as your own product, template collection, database, course or other resource, or use our protected materials to create a substantially similar or competing product. All intellectual property rights in the original materials remain with Nostra Fortuna BV unless expressly agreed otherwise.
Digital access
Where a digital product requires an account or login, access is intended for the purchaser or authorised account holder only unless otherwise stated. You are responsible for keeping your login details secure. The nature and duration of access, including whether access is ongoing, time-limited or linked to an active membership or subscription, will be stated with the relevant offer.
Right of withdrawal for digital content
Where applicable law provides a statutory withdrawal period and you request immediate access to digital content, you may be asked to expressly consent to delivery beginning immediately and acknowledge that you lose your statutory right of withdrawal once delivery begins, where permitted by applicable law. For EU/EEA consumers, this includes the rules applicable to the 14-day withdrawal period for digital content supplied immediately. Where the legal requirements for loss of the withdrawal right have not been satisfied, your statutory rights remain unaffected.
Refunds and guarantees
Certain digital products may be offered with a voluntary money-back guarantee. Where such a guarantee applies, its duration and conditions will be stated on the relevant sales or checkout page. Any voluntary guarantee offered by My Rising Jungle is additional to, and does not replace or restrict, mandatory consumer rights.
Memberships and subscriptions
Where a product or service is offered as a membership or subscription, the applicable price, billing frequency, included features and cancellation conditions will be disclosed before purchase.Recurring payments will continue according to the billing arrangement selected at purchase until cancelled in accordance with the applicable cancellation conditions.
4. Proposals, Scope & Project Agreements
Before commencing paid project work, we may provide a proposal, quotation, order form, statement of work or other written description of the agreed services.
The project-specific agreement may specify matters including: scope and deliverables; price and payment schedule; estimated timeline;
number of revisions; client responsibilities; third-party costs; recurring subscriptions or platform fees; and any additional project-specific conditions. If there is a conflict between these Terms and a specific written agreement between My Rising Jungle and the client, the specific written agreement will take precedence for the matter it addresses. Requests outside the agreed scope may require additional fees, revised timelines or a separate agreement.
5. Client Responsibilities
Clients are responsible for providing accurate information, materials, access, approvals and feedback reasonably required for us to perform the agreed services.
The client is responsible for ensuring that materials supplied to us—including text, images, trademarks, databases, contact lists and other content—may lawfully be used for the intended purpose. Delays in providing information, approvals, access or feedback may affect agreed timelines. We are not responsible for delays caused by circumstances reasonably outside our control or by a client's failure to provide required materials or decisions.
Clients remain responsible for reviewing and approving final materials, configurations, communications and implementations before they are used in their business, unless otherwise agreed.
6. Fees & Payment
Fees and payment arrangements will be specified in the applicable proposal, quotation, order or agreement.
Depending on the service, we may require: full payment in advance; a deposit before work begins; milestone payments; recurring subscription or service fees; final payment before launch, transfer or delivery.
Unless otherwise stated, third-party software, advertising spend, domains, hosting, messaging charges, licences and other external costs are not included in our fees. Where invoices are overdue, we may suspend work, delivery, platform access or ongoing services until outstanding amounts are paid, subject to applicable law and the relevant agreement. Any applicable VAT or other taxes will be charged as required by law.
7. Revisions & Changes to Scope
Revisions included in a project will be determined by the applicable proposal or project agreement. Requests that materially change the agreed concept, functionality, deliverables or scope may be treated as additional work and may require additional fees and time. We will aim to inform the client where a requested change is likely to affect price, scope or timing before undertaking substantial additional work.
8. Cancellations, Suspension & Termination
Cancellation and termination conditions may vary depending on the service and will be specified in the applicable proposal or agreement where appropriate.
Fees already earned for work performed are generally non-refundable, except where otherwise agreed or required by law.
Where work has commenced, the client may be responsible for work completed and costs reasonably incurred up to the effective date of cancellation.
Either party may terminate an ongoing service where the other party materially breaches its obligations and fails to remedy the breach within a reasonable period after being notified, where a remedy is possible. We may suspend or terminate services where reasonably necessary because of non-payment, unlawful or abusive use, security risks, breach of these Terms or misuse of systems provided through us.
9. Intellectual Property
Clients retain ownership of materials and intellectual property they provide to us. Unless otherwise agreed in writing, My Rising Jungle retains ownership of its pre-existing intellectual property and reusable materials, including methodologies, processes, know-how, templates, frameworks, automation structures, systems and internal tools. Once all applicable fees have been paid, the client will receive the rights or access to final project deliverables specified in the applicable project agreement. Third-party software, fonts, stock assets, plugins, templates, AI tools and other licensed materials remain subject to the rights and licence conditions of their respective owners.
Unless otherwise agreed, working files, internal processes, unused concepts, development materials and internal tools are not automatically transferred to the client.
10. Software, CRM & Platform Access
Some My Rising Jungle services may include access to software functionality, CRM systems, automation tools, forms, funnels, calendars, messaging systems or other digital infrastructure provided through third-party platforms, including HighLevel (GoHighLevel).
Where a client receives access through My Rising Jungle's agency or platform environment, that access does not automatically transfer ownership of My Rising Jungle's underlying agency account, software licence, configurations, templates, systems or other proprietary infrastructure.
Access may depend on an active service or subscription with My Rising Jungle and on the continued availability and operation of the relevant third-party platform.
The applicable proposal or service agreement may specify: functionality included, user access, subscription fees, usage or communication charges, integrations, support, data responsibilities and arrangements following termination.
Clients are responsible for their lawful use of these systems and for ensuring that personal data, marketing communications, contact lists and other information processed through their account comply with applicable laws. Where a service ends, we will take reasonable steps, where technically available and contractually applicable, to facilitate access to or export of relevant client data. Migration, transfer, rebuilding or continued platform access may require additional work or fees. We cannot guarantee that a third-party provider will continue to offer any particular functionality, integration, pricing or service.
11. Third-Party Platforms & Services
Our services may rely on third-party providers, including hosting companies, CRM and automation platforms, social networks, advertising platforms, payment processors, analytics providers, AI providers, APIs and other software services. We do not control these third parties and cannot guarantee their uninterrupted availability, functionality, policies, pricing or future compatibility. We are not responsible for failures, outages, restrictions, account actions, API changes, algorithm changes or other events caused by third-party services that are outside our reasonable control. Where a third-party service requires the client to maintain its own account, licence or subscription, the client is responsible for maintaining it unless otherwise agreed.
12. AI, Automation, Audits & Consultancy
My Rising Jungle may use AI-supported technologies in providing certain services and may provide advice, assessments, recommendations or implementation relating to AI and automation.
AI and automation technologies can produce incomplete, inaccurate or unexpected results. We therefore use such technologies as tools within a broader professional process rather than representing their outputs as infallible.
Audits, assessments, consultancy and recommendations are based on the information reasonably available to us at the time and are intended to support business decision-making. Unless expressly agreed otherwise, our services do not constitute legal, tax, accounting, financial or other regulated professional advice.
The client remains responsible for business decisions and for reviewing the suitability of recommendations and implementations for its organisation.
13. Content Strategy, Social Media & Training
Content strategy, social media advice, Instagram training, workshops and related services are intended to provide professional guidance, skills and practical recommendations. Social media platforms, algorithms, audience behaviour and market conditions can change rapidly. We therefore cannot guarantee particular levels of reach, followers, engagement, leads, sales or other commercial outcomes.
Where we provide templates, training materials, frameworks or educational resources, they may be used by the client for its own business purposes but may not be reproduced, resold, distributed or used to create competing training products unless expressly permitted in writing.
14. Results & No Guarantee
We aim to provide services professionally and with reasonable care. However, we do not guarantee specific business outcomes, including revenue, profit, leads, conversions, rankings, audience growth, cost savings or other commercial results. Results depend on many factors outside our control, including the client's implementation, market conditions, customer behaviour, platform changes, competition, advertising budgets and third-party technologies. Any examples, projections, estimates or potential benefits discussed during an audit, proposal, consultation or marketing communication are illustrative and are not guarantees of future performance.
15. Confidentiality
During a project, either party may receive confidential business, technical or commercial information belonging to the other. Each party agrees to take reasonable steps to protect confidential information and not disclose it unnecessarily to third parties, except where disclosure is required to perform the services, is authorised by the other party, is already lawfully public, or is required by law. This obligation does not prevent My Rising Jungle from using general skills, experience, knowledge and know-how gained while performing services, provided we do not disclose the client's confidential information.
16. Data Protection & Privacy
Each party is responsible for complying with applicable data protection and privacy laws in relation to personal data it controls.
Our processing of personal data in connection with the My Rising Jungle website and our own business activities is described in our Privacy Policy. Where My Rising Jungle processes personal data on behalf of a client, additional data-processing terms or a Data Processing Agreement may apply where required. Clients remain responsible for ensuring that personal data they collect, upload, import or instruct us to process has been collected and may be used lawfully.
17. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law. To the extent permitted by law, My Rising Jungle will not be liable for indirect or consequential losses, loss of anticipated profits, loss of business opportunities or losses resulting from circumstances outside our reasonable control.
Where My Rising Jungle is liable in connection with a service, our aggregate liability will, to the extent permitted by applicable law, be limited to the fees paid or payable to My Rising Jungle for the specific service giving rise to the claim during the 12 months preceding the event giving rise to the claim, unless another liability limit has been expressly agreed in writing. The client is responsible for maintaining appropriate backups and safeguards for business-critical information and systems under its control.
18. Website Use
You may use our website for lawful purposes. You may not knowingly: interfere with the operation or security of the website, attempt unauthorised access to restricted systems, introduce malicious software or harmful code, copy or commercially exploit protected website content without permission or use the website in violation of applicable law.
Content on our website is provided for general informational purposes and does not create a client relationship merely because you access or read it.
19. International Services
My Rising Jungle may provide services to clients located in Belgium and internationally. Clients are responsible for informing us of legal, regulatory or industry-specific requirements that apply specifically to their business or intended use of our services where those requirements would not reasonably be apparent to us. The provision of services internationally does not alter the governing-law provisions below unless otherwise expressly agreed in writing.
20. Force Majeure
Neither party will be responsible for a failure or delay in performing obligations where caused by circumstances beyond its reasonable control, including significant internet or infrastructure failures, natural disasters, governmental actions, widespread service outages or other comparable events. This does not excuse payment obligations relating to services already properly provided.
21. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, business practices or applicable law. The latest version will be published on our website with the date of the most recent update. Changes will not retroactively alter agreed project-specific terms unless required by law or agreed between the parties.
22. Governing Law & Jurisdiction
These Terms and our services are governed by Belgian law, unless mandatory applicable law provides otherwise. Unless otherwise agreed in writing or required by mandatory law, disputes arising from these Terms or our services will be submitted to the competent courts in Belgium.
Before commencing formal proceedings, the parties are encouraged to attempt in good faith to resolve disputes through direct discussion where reasonably possible.
